IBC : Where petitioner filed petition under section 9 on account of respondent's failure to pay lease rent in respect of premises let out to be used for running a restaurant, in view of fact that respondent had already raised various disputes saying that building in question was constructed illegally and it was not issued even occupancy certificate, it could be concluded that petitioner failed to make out any case that outstanding amount was free from dispute and, thus, instant petition deserved to be dismissed
